Terms & Conditions

These Terms & Conditions govern your use of the Chubby Shark Playroom website (chubbysharkmalvern.com) and all bookings, purchases, and visits. By booking, purchasing, or entering the facility, you agree to these Terms.

1. About Chubby Shark Playroom

Chubby Shark Playroom, operated by Evara Care Solutions LLC, is a parent-supervised indoor play venue for children ages 0–8. It is NOT a daycare, drop-off center, or licensed childcare provider. A parent or authorized adult (18+) must accompany and actively supervise each child at all times. Children may not be left unattended. A signed liability waiver (via Smartwaiver) is required for every visitor and remains valid for 12 months from the date of signing. Socks are required in the play area; socks are available for purchase at the front desk.

2. Open Play

Pricing

$20 per child per session — includes one (1) accompanying adult and one (1) free café drink (espresso, latte, Thai tea, or green tea).
Additional adult: $5 per adult per session.
Children under 12 months: FREE, provided that at least one sibling purchases a session ticket.

Sessions & Hours

Three timed sessions run daily, seven days a week, with a 30-minute reset period between sessions. Sessions are capacity-controlled.

Weekday sessions: 9:00 AM–12:00 PM / 12:30–2:30 PM / 3:00–5:00 PM
Weekend sessions: 10:00 AM–12:00 PM / 12:30–2:30 PM / 3:00–5:00 PM

Walk-Ins

Walk-ins are welcome when session capacity is available. We cannot guarantee entry without a booking. If a session is full, walk-ins will not be accommodated. We strongly encourage all guests to book in advance via Wix Bookings.

Rescheduling & Credits

Sessions may be rescheduled with at least 24 hours’ notice before the session start time. A one (1) month booking credit will be issued and must be used within that period. Credits are non-transferable and have no cash value. No cash refunds are issued for open play.

3. Memberships

All membership plans are sold as one-time purchases per child. They are NOT subscriptions and do NOT auto-renew. Members must re-purchase when their plan period ends.

What’s Included

Unlimited open-play sessions, subject to booking and session capacity.
Monthly and Annual members receive 10% off party packages and café beverages. This discount cannot be combined
with any other promotion or offer.
The Trial membership is limited to one purchase per email address and does not include the 10% discount.

Membership Terms

All plans are per child and non-transferable.
All plans are non-refundable once purchased.
Memberships cannot be paused, placed on hold, or transferred to another person.
Unused sessions do not accrue as credits and have no cash value.

4. Birthday Parties

We offer three birthday party packages. Please review the table and policies carefully before booking.

*Baby Shark and Reef Shark are “Party Room Reservations”: your group has exclusive use of the private party room during the food
and cake portion, but the general play area is shared with open-play guests. These packages are NOT a full venue buyout.
Only Megalodon is a complete private venue buyout.

Party Policies

Gratuity

No automatic gratuity or service fee is added to any party package. Tipping is entirely at your discretion.

Deposit & Balance

A non-refundable deposit — $100 for Baby Shark/Reef Shark, $200 for Megalodon — is due at the time of booking via Wix Payments and is applied toward your total. The remaining balance is due in full on the day of your event, before the party begins, payable by Square (in person) or Wix Payments.

Additional Children

Additional children over the package maximum may be added at $10 per child, subject to overall venue capacity and advance approval. Please notify us in advance if your guest count may exceed the package limit.

Adults

Chubby Shark is a parent-supervised venue; one adult guardian per attending child is expected to be present. Adults attend at no additional charge. Party hosts provided by Chubby Shark staff are separate from the adult supervision requirement.

Setup & Cleanup

A 20-minute setup window is available before your party slot begins, and a 20-minute cleanup window follows the end of your party. Both windows fall outside your booked party duration.

Food Policy

Only food provided by our venue vendors — VIP Pizza for Baby Shark and Reef Shark; TukTuk Thai catering for Megalodon — is permitted inside the venue. The sole exception: you may bring your own birthday cake with advance notice and completion of an allergen acknowledgment form. Outside food and drinks are otherwise not permitted.

Themes & Décor

Reef Shark and Megalodon packages allow you to choose a theme; we decorate using our own original in-house décor. Baby Shark comes with our default Chubby Shark décor only. No photographer is provided at any tier.

Rescheduling & Cancellation

Rescheduling: You may reschedule your party once with at least 14 days’ notice before the event date.
Your deposit is applied to the rescheduled date.
Cancellation (any notice): The deposit is forfeited. No additional charges apply.
Venue cancellation: If Chubby Shark must cancel your party due to a facility emergency or issue on our end,
you will receive a full refund of your deposit.

5. Café

Café beverages are available during all open play sessions and parties, priced $3–$6. One café drink is included free with each child’s open play ticket. Monthly and Annual members receive 10% off café purchases (cannot be combined with other offers).

6. Health & Safety

Do not visit if anyone in your party has a fever, active illness, or contagious condition.
Socks are required for all guests in the play area, including adults. Socks are available for purchase at the front desk.
Age and size guidelines apply to certain play equipment; please follow all posted guidelines and staff instructions.
In an emergency, we are authorized to seek emergency medical care for your child; you are responsible for any resulting costs. This authorization is included in the signed liability waiver.

7. Photography & Media

We may photograph or video guests during visits for use in marketing, social media, and other promotional materials. When signing your Smartwaiver, you will have the option to opt out via a checkbox. If you did not opt out at signing and wish to opt out going forward, email us at support@chubbysharkmalvern.com. We will not use your child’s image in new marketing materials after receiving your request. Please note that photographs already published prior to your opt-out request cannot be retroactively removed from existing materials.

8. Conduct & Removal

We reserve the right to refuse entry to or remove any guest who creates a safety risk, engages in disruptive behavior, or violates our posted rules. No refund will be issued in such circumstances.

9. Liability

Use of the facility is subject to the signed Liability Waiver. To the fullest extent permitted by Pennsylvania law, Chubby Shark’s liability is limited as set out in that waiver. Nothing in these Terms limits liability for willful or reckless misconduct.

10. Intellectual Property

All site content, branding, and the Chubby Shark name and logo are owned by Evara Care Solutions LLC. Party themes offered by Chubby Shark are original décor concepts and are not affiliated with, licensed by, or endorsed by any trademarked character or franchise.

11. Changes to These Terms

We may update these Terms at any time. The current version will always be posted on this page with the “Last updated” date above. Continued use of our services after any update constitutes acceptance of the revised Terms.
